These Terms govern your use of the getkerno.ai website, your purchase of a Kerno software licence, and any consulting engagement you book with us. The licensed software itself is covered by a separate Licence Agreement.
The short version
- You can use this website and buy Kerno.
- We'll deliver what you pay for. If we don't, you get a refund within 14 days, no questions.
- Don't do illegal things with the software or the site. Don't try to break it.
- We're a small operation, so liability is limited to what you paid us.
- Disputes go through arbitration in a jurisdiction we'll agree on in good faith, defaulting to the laws of England and Wales.
Accounts and contact
We don't require an account on this website. When you purchase or enquire, we collect only the information described in our Privacy Policy.
Purchases
- Prices on the pricing page are in US dollars and exclusive of local taxes.
- Licences are delivered by email within 48 hours of payment clearing.
- Every purchase includes a 14-day money-back guarantee. Email hello@getkerno.ai within 14 days of purchase and we refund in full, no justification required. After 14 days refunds are at our discretion.
- If you purchased via a third-party marketplace (e.g. Gumroad, Stripe Checkout), that platform's terms also apply to the transaction.
Consulting engagements
- Consulting is scoped via a written statement of work before any payment is made.
- Payment terms, deliverables, and timeline are specified in the statement of work and override these general Terms where they conflict.
- The money-back guarantee does not apply to consulting; refunds for consulting are governed by the engagement's statement of work.
Acceptable use of this website
You agree not to:
- Attempt to breach, bypass, or overload security measures on this website.
- Submit content that is illegal, threatening, defamatory, or intended to defraud.
- Use automated tools to scrape the site at a rate that degrades service for other visitors.
- Impersonate any other person or entity when filling in forms.
Intellectual property
All content on this website — copy, design, the branding, the Kerno name — is our property. You may not reproduce it for commercial purposes without written permission. The licensed software is governed by its own Licence Agreement.
Warranties and disclaimers
The website is provided "as is". We make reasonable efforts to keep it online and secure but we don't guarantee uninterrupted availability. We make no warranty that the website or the software will meet every customer's specific needs — which is exactly why we offer a free 7-day trial and a 14-day money-back guarantee on every paid tier.
Limitation of liability
To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of these Terms, the website, or the licensed software, is limited to the amount you paid us in the 12 months immediately preceding the claim. We are not liable for indirect, incidental, or consequential damages (lost profits, lost data, business interruption). Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud.
Governing law and disputes
These Terms are governed by the laws of England and Wales unless we agree otherwise in writing. Disputes will first be resolved by good-faith negotiation; if that fails, by binding arbitration in a mutually-agreeable jurisdiction. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction.
Changes to these Terms
We may update these Terms from time to time. Material changes will be highlighted on this page and, for active customers, communicated by email. Continued use of the site or software after changes take effect constitutes acceptance.
